Privacy Policy

Kind Health Insurance Services, LLC (“Kind”, “we”, “our”, or similar terms) collects, uses, and secures personal information of users (“you”, “your” and similar terms”) of Kind’s owned websites [,] (collectively, the “Sites”).  This privacy policy, updated October 1, 2018, describes the information security and privacy practices Kind follows with respect to information you share with us via the Sites. This policy does not apply to information that Kind obtains about you from other sources.  

In order to assist you with your health insurance needs, and in our capacity as a licensed insurance agent, we will ask you to provide us with personal information regarding you and others on whose behalf or for whose benefit you use the Sites.  We use the personal information you provide to assist you in locating and applying for health insurance and other product as offered via the Sites.  We will only use and disclose your personal information pursuant to this privacy policy, as updated from time to time.     

Consent to Policy

By using the Sites, you consent to our collection and use of your information as described in this policy.  If you do not agree with these terms, you should not use the Sites.

Changes to the Policy

We reserve the right to amend or change this policy at any time.  Changes to the policy will be effective immediately upon posting to the Sites.  We will use our commercially reasonable efforts to notify you of changes to this policy by electronic mail or by clearly posting the changes on the Sites.  Information collected before any change goes into effect will be treated in accordance with the terms of the prior policy.  We will mark each version of our policy with an effective date.  You are responsible for reviewing this policy each time you use the Sites.  

Health Insurance Portability and Accountability Act of 1996 (“HIPAA”)

Kind’s use and disclosure of certain of your personal information may be subject to the requirements of the Health Insurance Portability and Accountability Act of 1996, commonly referred to as HIPAA, as amended by the Health Information Technology for Economic and Clinical Health Act (“HITECH Act”). Any information that you submit to us that constitutes “Protected Health Information,” as defined by HIPAA, is subject to HIPAA and HITECH. The term “Protected Health Information” or “PHI” refers to personally identifiable information about your past, present or future physical or mental health or condition, the provision of health care to you or the past, present or future payment for such care. If any information collected on the Sites constitutes PHI, then our Notice of Privacy Practices will apply.

Collecting Personally Identifiable Information

We do not collect personally identifiable information (“PII”) about you or others unless you choose to provide that information to us.  Should you choose to share PII with us, it will be protected by our security practices. Methods by which we may collect PII include your transmitting information to us via electronic mail or voluntarily sharing information via the Sites or an inquiry page.  Such PII may include your contact information, age, gender, date of birth, Social Security Number, health conditions, and other information you choose to provide us, subject to applicable law and the terms of this policy.   We may use third party service providers to assist us in collecting and maintaining this PII, however we require such service providers to maintain confidentiality of this information.  

Collecting Non-personally Identifiable Information

When you visit the Sites, we may automatically and passively collect and temporarily store non-personally identifiable information relating to your visits to the Sites. This information may be collected by various means, including “cookies”, which are small text files that are automatically placed on your computer, collection of your IP address, and information regarding the browser software and computer system that you are using, along with similar analytic data.  Our cookies include “session cookies” or single-visit files that gather data regarding how the Sites are used, and “persistent cookies” which last for multiple visits to the Sites and are used to customize the Sites for frequent visitors and gather information regarding variations of website design and content.  Session cookies expire when you leave the Sites and are automatically deleted from your computer when they expire.  Our persistent cookies are set to expire [duration] after your last visit to any of the Sites.  After such time, they are automatically deleted from your computer.  Kind cannot identify a specific individual by use of our cookies.  We may use your IP address (or, if available, GPS or other location data) to allow us to predict your geographic location; such information will be stored by us and used as a data point to provide recommendations of insurance and other products and services for you.  

Sharing of Your Personal Information with Third Parties

Business Partners

We may share your personal information with our business partners, including insurance companies, insurance agents, benefit plan trustees or administrators, and governmental exchanges and entities.  If you submit an application for an insurance product we offer via the Sites, we will disclose your information to the insurance company offering such product for processing of your application.  If you submit a request for information for an insurance product or other service offered via an insurance agent, agency, or other business partner of ours, we may disclose your personal information to the applicable business partner to process your application or request for information or to otherwise provide you with information about such insurance products or services.  If you complete an application with us that is processed through a governmental exchange or entity, we will disclose your personal information to the applicable exchange or entity.  Our business partners may only use your personal information to process your application, request for information, or enrollment information, and such partners are under legal obligation to maintain confidentiality of your personal information.  

Service Providers

We may provide your personal information to third parties that provide services to us in the ordinary course of our business.  Such service providers may include electronic mail providers, web hosting services, payment processors, data analytics providers, cloud-based storage and software-as-a-service providers, customer service contractors, and providers of other services.  These providers may access your information in connection with their provision of such services.  Such service providers are restricted to using your information solely in connection with their provision of services to us and are required to maintain strict confidentiality of your personal information.  

Our Affiliates

We reserve the right to share your information with entities that are affiliated with us (i.e., parents, subsidiaries, or other entities that control, are controlled by or are under common control with us), however all such affiliates are required to honor this policy with respect to any shared information.  

Legal Requirements

We may disclose your personal information or any other information we hold to the extent we believe disclosure is necessary or advisable to comply with requirements of applicable law or regulation or governmental request or is otherwise permissible under applicable law.  Examples of such disclosures may include disclosures made in compliance with subpoenas, other legal process, regulatory compliance, resolution of consumer disputes, cooperation with law enforcement, and protecting our rights, your safety, or the safety of others.  

Business Transactions

If we become involved in a non-routine business transaction, such as a material debt or equity investment, merger, acquisition, or sale of all or a portion of our assets, control of and access to your personal information may be transferred in connection with such transaction, or we may permit review of such information under confidentiality restrictions imposed on the other party or parties (or prospective parties) to any such transaction.  If we determine that material changes to this policy will result from the relevant business transaction, we will make a reasonable attempt to to notify you by sending you an email and/or posting a prominent notice on the Sites alerting you to the transition.

Your Prior Consent

We may disclose, share, or use your personal information in any manner with respect to which you provide us with an indication of your consent to such disclosure, sharing or use.   An example might include your election to “opt in” to social media that we maintain, or to mailing lists, or promotional updates.  If you do “opt in” for such programs, we may disclose your applicable personal information to social media platforms where Kind maintains accounts for the purpose of carrying out your “opt in” election and including you in such programs.  In such cases, the social media platforms would restricted from use of your personal information for their own purposes unless you have an individual account with such platform, in which case they would generally be obligated to handle your information in accordance with their applicable privacy policies.    

Our Use of Personal Information


We do not begin to collect personal information from you unless or until you register with us.  You may register with us through the Sites by entering your e-mail address and if you choose to create an account, establishing a password.  Our current process requires that you create an account in order to proceed to submit an application for health insurance or other products or services offered on the Sites.  

Health Insurance and other Product/Service Applications

We may request that you provide us with your personal information (including health information) regarding you and any family member or third party you wish to include in an application should you elect to apply for health insurance or other products or services through the Sites.  This information will be used by our business partners to process your application.  We may also request that you provide payment information (such as bank account and/or credit card information) and your social security number which may be used by our business partners to process your application, collect fees in connection with such application, and collect insurance premiums or other sums due upon approval of your application.  If you use the Sites to apply for government-paid health insurance or other subsidies or for health insurance via a governmental exchange, we may ask you for personal information such as financial, tax-related and household information that we may pass on to governmental agencies or exchanges for processing of such subsidies and applications.  

Quotes and Application Processing

We may use your personal information to contact you as necessary to process an application or provide you with a requested quote.  For example, we may send you electronic mail or contact you by telephone to inform you of your application status and request additional information as needed in connection with your application or quote request.

Customer satisfaction, referrals, other products and services

We or our affiliates may contact you with customer satisfaction surveys or other requests for information, or to refer our products and services to others, or to inform you of additional products and services we offer.  You may opt out of receiving such communications by following the procedures described below.

Security and Confidentiality

We maintain various methods to secure your information, depending on the nature and extent of the collected information.  We strive to update our security methods for information stored on our servers or those of our service providers to equal or better then-current industry standards for such security.  Despite our best efforts, be aware that communication via the Internet is inherently subject to security risks and as a result security breaches will occur.  As a result, we seek to design our systems so that any breaches that may occur will result in the compromise of minimal amounts of data.

Updating your Information

Should your previously-submitted personal information change, or you wish to update or delete your information held by us, you may contact us by email at  Additionally, you may update your information via the Sites by signing into the sites and directly updating your information as you choose.  We will retain your personal information for so long as you maintain an active account on the Sites or as needed to provide you with products and services.  We will further retain and use your information as needed to comply with legal obligations, resolve disputes, and enforce agreements.  Note that if applications have been submitted to our business partners or other third parties, you may have to contact such business partner or third parties in order to have your information updated or deleted, as applicable.   

Notice of Changes

If we seek to use your personal information in a manner other than as reflected in this policy at the time of collection, we will notify you of such change by e-mail or by posting a notice on the website prior to the change becoming effective.  You may decline permission for us to use your personal information in the different manner.  Changes to this policy that do not affect previously collected information will be the subject of notification to users in the privacy portion of the Sites.  We will not notify you of changes in our usage or disclosure of your non-personally identifiable information as such information is by its nature anonymous.  

Opt Out Process

Unless you affirmatively elect to opt out of such programs, we may contact you in connection with customer satisfaction surveys, to notify you of additional products and services.  If you wish to opt out of such programs, contact us at  You may additionally opt out of newsletters or other periodic informational communications with you by following the unsubscribe instructions included in such e-mails.  You may still receive communications from us regarding insurance quotes, applications, policies, tax credits or subsidies or other similar items even if you opt out of our customer satisfaction surveys and notifications of additional products and services.  

Application to other websites

This privacy policy applies only with respect to the Sites listed above.  Information submitted to other websites owned or operated by Kind may differ.  If you are returning to the Sites to complete an application begun on a Kind-owned or operated website other than the Sites, please review the privacy policy of the website on which you began your application to learn about the privacy practices that apply to the personal information you submitted via such other websites.  Should you wish to have your personal information subject to the practices described in this policy, you may initiate a new application via the Sites.

Nondiscrimination Statement

KindHealth does not discriminate on the basis of race, color, national origin, disability, age, sex, gender identity, sexual orientation or health status in our health plans, when we enroll members or provide benefits.
